It’s been quite the week for reconsidering legal action. Earlier, the woman who wanted a restraining order against Randy Moss chose to cancel her charges. And now, the BOSTON GLOBE reports that a lawsuit over New England’s Super Bowl XXXVI victory has been dropped.
Last month, a group of fans along with ex-St. Louis Ram Willie Gary filed the $36 million lawsuit, claiming the Patriots committed “fraud, racketeering and breach of contract” by secretly taping a Rams pre-game walkthrough.
However, the group changed their minds when it appeared that they wouldn’t be able to use their star witness:
In court papers filed yesterday, the plaintiffs’ attorneys said they filed the lawsuit in hopes of subpoenaing former Patriots employee Matt Walsh, who has intimated in interviews that he has materials that could prove damaging to the Patriots.
Saying that Walsh would likely exercise his constitutional right not to incriminate himself, the lawyers called getting him to testify as “an exercise in futility.”
And the Rams are certainly current masters of exercises in futility. But a lawyer for Gary said the lawsuit could be refiled, depending on what Walsh finally tells the NFL, if anything.
If the suit is revived, a word of warning to the plantiffs - when Walsh is in the courtroom, watch where you sit.
